Joseph H. Meltzer focuses on complex, high-stakes litigation involving fiduciary misconduct, consumer protection, and antitrust violations. For more than two decades, he has represented institutional investors, public entities, and other sophisticated clients in matters where the alleged misconduct has affected thousands or even millions of people and put hundreds of millions of dollars at issue.

At Radnor Law Group, Joe draws on a national track record of prosecuting breach-of-fiduciary-duty cases, including actions brought under ERISA and other fiduciary regimes. He has served as lead or co-lead counsel in numerous nationwide class actions and other large cases on behalf of pension funds, retirement plans, and other institutional investors. His work has contributed to some of the largest recoveries obtained in fiduciary-breach and securities-lending disputes, with aggregate client and class recoveries measured in the billions of dollars.

Joe also has extensive experience in consumer-protection litigation. He has represented individuals, businesses, governmental bodies, and other organizations harmed by defective products, unfair or deceptive business practices, and misleading financial services. Over the course of his career, he has helped design and litigate complex class and mass actions aimed not only at securing compensation, but also at changing how products and services are marketed, priced, and administered.

In the antitrust arena, Joe represents clients injured by anticompetitive conduct such as collusive schemes, exclusionary tactics, and other unlawful business practices. A significant portion of his work has focused on the pharmaceutical and health-care industries, including cases involving alleged overcharges on prescription drugs and health-care expenditures, as well as matters involving financial markets and other commodities. He has also been appointed as a Special Assistant Attorney General in pharmaceutical-pricing litigation, representing states seeking to recover losses tied to allegedly unlawful pricing and marketing practices.

Joe’s cases often involve complex economic and regulatory questions and have resulted in substantial recoveries. His experience includes leading or playing a central role in:

  • Pharmaceutical antitrust matters challenging delayed generic competition and other exclusionary conduct, resulting in nine- and ten-figure settlements for direct purchasers and other end payors.
  • State enforcement actions brought by Attorneys General relating to the marketing and sale of atypical antipsychotic drugs, leading to multimillion-dollar recoveries for affected states.
  • Financial-institution litigation involving the treatment of American Depositary Receipt (ADR) holders and the assignment of improper conversion rates, which led to meaningful monetary recoveries for investors.
  • Securities-lending and foreign-exchange disputes in which custodial banks and other financial institutions were alleged to have retained improper profits or mismanaged collateral pools, resulting in substantial settlements and arbitral awards for institutional clients and class members.

Beyond his litigation practice, Joe is active in professional organizations connected to his areas of focus. He has held leadership and committee roles within the American Bar Association, particularly in antitrust and employee-benefits committees, and has participated in initiatives concerning the preservation and effective use of the class-action mechanism. He is also involved with state and local bar associations and supports a number of public-interest and community organizations.

Joe frequently speaks on ERISA and fiduciary litigation, complex class actions, and antitrust enforcement. Courts and colleagues alike have recognized his ability to manage intricate cases, collaborate with experts, and present sophisticated issues in a clear and persuasive manner.
